Post Office, 22-23 Cecil Square, Margate CT9 1AA Minutes: Change of use from offices to 2no. 3-bed flats, and 6no. 2-bed flats, demolition of rear extension, erection of 1no 3-bed dwelling and 1no. 2-bed dwelling and formation of vehicular access onto Pump Lane.
Following the site visit on 13 April 2012 the proposal has been amended to the following:-
Change of use from offices to 2no. 3-bed flats, and 6no. 2-bed flats and demolition of rear extension and formation of vehicular access onto Pump Lane.
Simon Thomas advised Members that due to the above amendment to the proposal there was now no need for a contribution from KCC and the recommendation from officers was to approve the application. Conditions would be amended to reflect the amended application.
Moved by Councillor Cohen and seconded by Councillor Mrs Tomlinson that:
“the application F/TH/11/1052 be approved subject to the following conditions:
(1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
GROUND: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
(2) The development hereby approved shall be carried out in accordance with the submitted application as amended by the revised drawings numbered AD011-12/100/06/A, AD011-12/100/07/A, AD011-12/100/08/A, and AD011-12/100/09/A dated 08 March 2012; revised drawings numbered AD011-12/100/04/B, AD011-12/100/05/B, and AD011-12/100/10/B dated 18 April 2012; the additional joinery details numbered AD011-12/100/11 and AD011-12/100/12, dated 02 March 2012; and the additional balcony details received 06 March 2012.
GROUND: To secure the proper development of the area.
(3) No development shall take place until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to, and approved in writing by, the Local Planning Authority. Development shall be carried out in accordance with the approved details.
GROUND: In the interests of visual amenity in accordance with Policy D1 of the Thanet Local Plan.
(4) No development shall take place until details of the means of foul and surface water disposal, including details of the implementation, management and maintenance of any proposed Sustainable urban Drainage Systems, have been submitted to and agreed in writing by the Local Planning Authority. The development shall be carried out in accordance with such details as are agreed and thereafter maintained.
GROUND: To prevent pollution in accordance with Policy NRM2 of the South East Plan.
(5) If, during development, significant contamination is suspected or found to be present at the site, then this contamination shall be fully assessed and an appropriate remediation scheme agreed with the Local Planning Authority. The approved works shall be implemented within a timetable agreed by the Local Planning Authority and shall be of such a nature as to render harmless the identified contamination given the proposed end use of the site and surrounding environment, including controlled waters.

Moved by Councillor Cohen and seconded by Councillor Mrs Tomlinson that:
“the application L/TH/11/1053 be referred to the Secretary of State for Communities and Local Government with a recommendation for approval, subject to the following conditions:
(1) The works to which this consent relates shall be begun not later than the expiration date of three years beginning with the date on which this permission is granted.
GROUND: In pursuance of Section 18 of the Planning (Listed Buildings and Conservation Areas) Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

GROUND: To secure a satisfactory external treatment and to safeguard the special character and appearance of the property as a Listed Building in accordance with advice contained within National Planning Policy Framework.
(6) Prior to the commencement of works, detailed drawings of the railings at a scale of 1:5 (which shall be of the approved design received 06 March 2012), along with details of the finish, shall be submitted to and approved in writing by the Local Planning Authority. Moved by Councillor Campbell and seconded by Councillor Mrs Tomlinson that:
“the application F/TH/11/1079 be approved subject to the following conditions:
(1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
GROUND: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
(2) The proposed development shall be carried out in accordance with the submitted site plan, drawing numbered Q887H_001_05 received by the Local Planning Authority on 1 March 2012, Site Location Plan received by the Local Planning Authority on 7 March 2012 and letter and attached plan from the applicant’s agent received by the Local Planning Authority on 30 March 2012.
GROUND: To secure the proper development of the area and in the interest highway safety in accordance with Thanet Local Plan Policy TR16.

Moved by Councillor Cohen and seconded by Councillor Campbell that:
“the application F/TH/12/0081 be refused”
MOTION LOST.
Following some debate the following was moved by Councillor Mrs Tomlinson and seconded by Councillor Hayton that:
“the application F/TH/12/0081 be deferred and delegated to officers to approve subject to the addition of appropriated safeguarding conditions”
as the members considered that the development would be an enhancement to the streetscene, and therefore constitute an acceptable departure from Policy H1 of the Thanet Local Plan.

The Cherry Orchard, The Centre, Ramsgate CT12 6LD Minutes: Erection of 15No. dwellings with associated parking.
Moved by Councillor Campbell and seconded by Councillor Mrs Tomlinson that:
“to defer and delegate the application F/TH/12/0083 to the Community Services Manager to approve subject to the completion of a unilateral undertaking, and subject to the following conditions:
(1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
GROUND: In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
(2) No development shall take place until details of the means of foul and surface water disposal have been submitted to and agreed in writing by the Local Planning Authority. These details shall include all surface water drainage from parking areas being passed through an oil interceptor designed and constructed to have capacity and details compatible with the site being drained. The development shall be carried out in accordance with such details as agreed.
GROUND: To reduce the risk of flooding and to prevent pollution in accordance with Policy EP13 of the Thanet Local Plan.
(3) No development shall take place until details of the diversion and/or protection of the public sewers and water mains have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with such approved details.
GROUND: To reduce the risk of flooding and to prevent pollution in accordance with Policy EP13 of the Thanet Local Plan.
(4) No development shall commence until a site characterisation and remediation scheme has been submitted to and approved in writing by the Local Planning Authority and the remediation scheme for that phase has been implemented in accordance with the approved details. The site characterisation, remediation scheme and implementation of the approved remediation scheme shall be carried out in accordance with the following criteria:
(a) Site Characterisation An investigation and risk assessment, in addition to any assessment provided with the planning application, shall be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to approval in writing of the Local Planning Authority. The investigation and risk assessment shall be undertaken by competent persons and a written report of the findings shall be submitted to and approved in writing by the Local Planning Authority, and shall include:
· A survey of the extent, scale and nature of contamination · An assessment of the potential risks to:
· An appraisal of remedial options and a recommendation of the preferred options
The site characterisation report shall be conducted in accordance with British Standards and current DEFRA and Environment Agency best practice.
