(1)  The proposed development would, by reason of its size, close relationship with neighbouring properties and lack of suitable arrangements for car parking, be likely to cause an unacceptable impact on the character and amenity of the locality in terms of noise, disturbance and an inconvenience to road users, undermining the quality of life of local residents and is therefore contrary to Thanet Local Plan Policy H11, D1 and the national planning policy Framework”

GROUND:

In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

(3)  No amplified music, recorded music or any other amplified sound (from loudspeakers or PA systems) shall be audible in habitable rooms of any occupied residential premises either attached to or in the vicinity of the premises to which this application relates.

To safeguard the residential amenities currently enjoyed by the occupiers of nearby residential properties.

 

(4)  Prior to the first use of the property hereby approved, the windows at first floor level to the side elevation shall be fixed shut and obscured film (etched glass finish) shall be placed over the glazed sections of these windows to a minimum of 1700mm above floor level, in accordance with the approved plan and shall thereafter be maintained.

 

GROUND:

To safeguard the privacy and amenities currently enjoyed by the occupiers of adjoining residential properties in accordance with Policy D1 of the Thanet Local Plan.

 

(5)  The door to the side elevation, identified on the approved plan as an emergency exit shall remain closed at all times apart from in the case of an emergency and shall be fitted with an alarm that shall be maintained in full working order.

the application L/TH/12/0246 be approved subject to the following conditions:

 

(1)  The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

 

GROUND:

In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

 

(2)  No works shall take place until the applicant, or their agents or successors in title, has secured the implementation of a programme of building recording in accordance with a written specification and timetable which has first been submitted to and approved in writing by the Local Planning Authority.

Moved by Councillor Cohen and seconded by Councillor Campbell that:

 

the application F/TH/12/0345 be refused for the following reasons:-

 

(1)  The proposed development, by virtue of the siting of the proposed dwellings, their scale, proportion, design which includes part flat roof and the parking spaces within the front elevations would appear cramped and out of keeping with the established pattern of development, and would detract from the character and appearance of the surrounding area, contrary to Thanet Local Plan Policy D1, South East Plan Policy BE1 and advice contained within the National Planning Policy Framework.

 

(2)  The proposed development, by virtue of the scale of unit 3 and its relationship with no. 49 Walmsley Road would result in the creation of a sense of enclosure to the occupiers of this property, whilst the relationship between the proposed dwellings would cause an overbearing impact to the proposed unit 2 and severe overlooking to unit 3 to the detriment of the amenities of the potential future occupiers of these properties, contrary to Thanet Local Plan Policy D1”
