Land Adjacent Marine Drive and, The Parade, Margate

Minutes:

Construction of stepped revetment, refacing of sea wall, erection of new sea wall and flood gates following demolition of existing, extension of sea wall and erection of flood gate adjacent to Harbour Arm, without compliance with condition 2 of planning permission F/TH/11/0248, to amend the design.

 

Moved by Councillor Binks and seconded by Councillor Kirby that:

 

“the application F/TH/11/0790 be approved subject to the following conditions:

 

(1)  The development hereby permitted shall be begun before the   expiration of three years from the date of this permission.

 

GROUND:

In accordance with Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

 

(2)  The development hereby approved shall be carried out in accordance   with the submitted plans.

 

GROUND:

To secure the proper development of the area.

 

(3)  Prior to the commencement of the development hereby approved   details of the facilities for the loading, unloading and turning of   construction vehicles, which shall be used for the duration of   construction, shall be submitted to, and approved in writing by, the   Local Planning Authority.

 

GROUND:

In the interests highway safety.

 

(4)  Prior to the commencement of the development hereby approved   details of the parking facilities for site personnel and visitors, which   shall be used for the duration of construction, shall be submitted to,   and approved in writing by, the Local Planning Authority.

 

GROUND:

In the interests of highway safety.

 

(5)  At the time of the development the ‘sturgeon’ lighting columns shall be   provided atop the proposed sea wall.

 

GROUND:

In the interests of visual amenity of the area, as a Conservation Area, in accordance with Thanet Local Plan Policy D1 and Planning Policy Statement 5.

 

(6)  Prior to the commencement of the development hereby permitted, full details of the method by which the ‘Kings Stairs’ will be preserved in   situ shall be submitted to, and approved in writing by, the Local   Planning Authority. The development shall be carried out in   accordance with the approved details.

 

GROUND:

To ensure the preservation of a non-designated heritage asset, in accordance with the guidance contained within Planning Policy Statement 5.

 

(7)  Prior to the commencement of the development hereby approved, full details of the sea wall, including how it would integrate with the   revetments, shall be submitted to, and approved in writing by, the local   planning authority. The development shall be carried out in accordance   with these details, as are approved.

 

GROUND:

To safeguard the special character and appearance of the area as a Conservation Area, in accordance with guidance contained within Planning Policy Statement 5.

 

(8)  Within Zone F, as shown on drawing entitled ‘Margate Flood and Coast   Protection Scheme – Construction Zones’, received on 12th July 2011,   no construction works which would give rise to impact noise likely to   cause disturbance of birds, including piling and the use of percussive tools, shall take place during a two hour period commencing one and a   half hours before high tide until half an hour after high tide between 1st   October until 31st March inclusive.

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(9)  Within Zone E and the adjacent works to the north east, comprising the   construction of flood gates and a floodwall, as shown on drawing   entitled ‘Margate Flood and Coast Protection Scheme – Construction Zones’, received on 12th July 2011, no works shall take place between   1st October until 31st March inclusive.

 

GROUND:

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(10)  During construction, the slipway, shown on drawing entitled ‘Margate   Flood and Coast Protection Scheme’ – Construction Zones’, received   on 12th July 2011, shall not be used for access by the contractor during   a period between one and a half hours before high tide and half an   hour after high tide. Car parking and pedestrian access to the slipway will also be restricted during this period through the closure of the   floodgate.

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(11)  Prior to the commencement of the development hereby permitted, a   Hessian fence shall be erected, in accordance with the details   contained within the ‘Measures to mitigate roosting bird disturbance   and avoid chalk reef damage’ report, dated 12th July 2011. This fencing   shall remain in place for the duration of construction.

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(12)  Prior to the commencement of the development, hereby approved, and   for the duration of the construction works, a floating vessel, half of   which shall be covered with 50mm of sand and, in part overlayed with   seaweed, shall be moored within the harbour between 1st October and   31st March of any year.

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(13)  Within Zone E, as shown on drawing entitled ‘Margate Flood and Coast   Protection Scheme – Construction Zones’, received on 12th July 2011,   the timber fender, shown on drawing number 2914/41, received on 12th   July 2011, shall be provided concurrently with the development hereby   approved and thereafter maintained.

 

GROUND:

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

 

(14)  Prior to the commencement of the development hereby approved, the   method for monitoring activity of over wintering birds on the floating   vessel and timber fender shall be submitted to, and approved in writing   by, the Local Planning Authority. The method of monitoring, as approved, shall be carried out concurrently with the development.

In the interests of nature conservation in accordance with Planning Policy Statement 9 and the Conservation (Natural Habitats) Regulations 1994.

Should works take place near Tivoli Brook (near TR35219 70963) it is strongly recommended that details of the works are provided, and access permitted, to Environment Agency, so that an informed assessment of bacterial contamination of the brook can be established.
